Can I register my own Company in Malaysia?

Yes, now you have an opportunity to register your own company in Malaysia. Legally, without any “Local Malaysian Director”, simply saying a “100% Foreign Owned Company”!. But the minimum paid up capital (CASH) MUST be RM 500,000 on which you may apply your director visa. This detail appears on Section “D” of Form 24 of SSM Forms. But have in mind that It must be clearly written that RM500,000 is “FULLY PAID Up or ISSUED. Cheaters just show RM 500,000 in the “AUTHORIZED Capital” column which DOES NOT means that it is CASH and fully paid up.

What is a Professional Work Permit Visa?

Professional Work Permit is an Employment Pass for 2 years (DP10 Visa). Professional Work Permit is issued to Top Level Management ( Company Directors, Managers ) and Highly skilled professionals. It means that an expatriate from another country is a one of the company director/shareholder or Highly Skilled and is Offered a Top level position/Skilled Job in Malaysia. The skilled categories are the same as in Western Countries – IT Professionals, Teachers, Doctors, Nursing and Managers. In simple words it is an ‘Employment Pass’ issued by the Government for Employees of a Company. The initial validity of the pass is 2 years but it can be extended for 10 years.

A Company (Sdn. Bhd. i.e. Private Limited) needs to have a “CASH” Paid Up capital minimum RM 500,000/- to qualify for recruiting Foreign Staff including Work Permits for company Directors.

      Patel>> DP11 visa=Dependent Pass. Which you can apply only if you are a “Dependent” of a DP10 visa holder.
      So, DP11 is not for you!
      May be because of lack of information, you mentioned DP11.
      If you want to settle in Malaysia, you need to apply DP10 visa and then hereafter, if you are married, your wife (and children under 18 and parents) would be able to apply DP11 visa.
      To apply DP10 visa, You may visit BSBH office in Kuala Lumpur by arranging an appointment.

      Sarabjit>> you can convert visit visa into Work Permit once your work permit gets approved. But remember, you cannot convert visit visa into “General Category” (low category work permits: plantation, service sector, construction etc..). You can convert visit visa only into high category work permit (DP10).

      Ajinkya>> There is no “simplest process” in Malaysia for work permit. Work Permit can be applied only by a “Company”. No individual can apply at own. What type of your company is which want to “relocate” to Malaysia but does not to register itself! Or else, may be you just need a work permit then you can find any “agent” which may be very risky. Alternatively, you may contact QADKAM for assistance in applying work permit under their own company.

      Alam>> Your Dependents are attached to your work permit. If your work permit is near to expire, your dependents will also NOT get extension. You need to extend your work permit first then only you can extend the dependents pass. Alternatively you may visit Immigration office for exact information.

      For your own extension; please bear in mind. Now, to extend your work permit, your company must be having “ESD Online” account..means your company must be registered with ESD immigration website. So, start your work permit extension process now so that if your company needs to be registered with ESD, it could be done well in time otherwise, your can be over stay if your company is not registered with ESD till your work permit expiry date.
      For further assistance, you may contact QADKAM office in KL.

      Faisal>> Malaysia has NOT stopped high category work permit for Bangladesh. The only problem is for low category “General/Skilled/Unskilled worker. DP10, still we are processing.
      From Bangladesh, you can send money due to local laws in Bangladesh. So if you wish to proceed, you can pay through your any friend who is already in Malaysia or you may visit Malaysia to have face-to-face consultation from QADKAM Professionals.

          Md.Akramul Haque>> If your work permit is already approved and you have applied VDR (visa with reference) and have enclosed a “Sealed Envelop” sent to you from Immigration Department then there is no need to worry. There is NO ban from Immigration Department on Bangladeshi Passport. Make sure you really received the approval of your work permit which comes in a “Sealed Envelop” which is required to submit to Malaysian High Commission to get VDR.
          You may check your visa approval from Malaysian Immigration Department website by entering your employer company number in search box tool.

    Hi, i have a friend who is a Japanese working in Malaysia. Her boss doesn’t like her and terminate her contract and want to cancel her EP. The boss asked for her passport to do the cancellation but my friend refused to give.
    The EP expires end of this year.
    Can my friend still stay in Malaysia until the EP expires even though contract has been terminated?
    What would be the impact or potential action by the employer?

      Kay>>Employer may send the request to immigration department for the cancellation of EP after terminating the contract. If the employer company has ESD website online access or the company is I.T company, then the work permit cancellation request can be submitted online.

After cancellation of EP she can enter again in Malaysia on social visit and can be given a social visit pass (tourist visa) on arrival.       Prathap>> Please have in mind. There is NO any category of work permit in Malaysia which you can apply at your own on basis of your qualification/skill. Only your employer company can apply work permit or alternatively you can register your own company and then may apply work permit as “Company Director”. There is no special category of Malaysian Work Permit purely for skilled person as in Australia or Canada.
      But QADKAM Worldwide may assist you in getting work permit through it’s I.T company in Malaysia, if you fulfil the requirements.

      raja>> You legal in Malaysia till exactly the date of your work permit. You can check this date from the work permit sticker. Once it’s expire and even then you remain in Malaysia, you will considered ILLEGAL and will be charged with “Overstay” penalty. There is only one option, you could apply “Special Pass” BEFORE the expiry date of your current work permit. If you did not get “Special Pass”, then you are ILLEGAL in Malaysia. (sorry to inform you!)

US visa has nothing to do with your current visa status unless you meet other requirements set by the US embassy Kuala Lumpur. Please have in mind, every country has it’s own visa policy. Only citizens of Malaysia have different criteria but for Foreigners it depends on the actual nationality of the applicant.

      Faisal>> Normally, once DP10 is approved, it’s VDR can be obtained in just 3 working days. If it is delayed, it means Immigration Department is investigating how it was approved. Because, in these days, if you apply DP10 visa through 3rd party (Flying Agents), it is almost impossible to get the DP10 sticker. This is the reason, we always urge the foreigners to be careful from “Flying Agents”. The easiest way to settle in Malaysia is; register your company in Malaysia, start business and get your DP10 visa pasted on your passport…that’s it!

      Sethi>>You can buy any type of business if you have a company in Malaysia. But getting work permit is subject to some conditions set by immigration department. To get work permit, your company must have at least RM1 Million Paid up capital…and also the license according to the activities of your company. If there are such activities entered in your company’s Memorandum which requires more licenses then your work permit application can be REJECTED if you apply work permit without those licenses.       You don’t need to go for cancellation. After 21st January, 2015 your work permit will automatically be expired.

      nadila>>If you got a stamp of refusal of entry on your passport then again you can be sent back. But if there is no such stamp on your passport, then again you may visit Malaysia on the same visa as long as it remains valid. Check your visa ISSUE DATE. Once a visa is issued, it can be used multiple times/entries within 3 months from the date of issuance and each entry is limited to 30 days. Further, you may send your passport number to QADKAM to check with Immigration Department. Furthermore, QADKAM Worldwide may also assist you in applying Work Permit for 2 years.

What we recommend, you simply ask your prospective employer to give a written “Offer Letter” for the job which you intend to start with. Go to DP10 section of Immigration Department in Putra Jaya and ask the Immigration Department to fix an “Endorsement” of “Permitted to Work” in your passport. Actually “Dependent Pass” holders are allowed to enter into paid employment but just an “Endorsement” is required from Immigration Department which is granted “FREE” of charge.

    Me and my friends had an interview(February 11, 2014) for a Malaysian Employer (Hotel/Hospitality Industry) under an agency. And after the interview we got hired by the company. We finished all our requirements around March 13 2014.       Herpreet>> You can NOT apply “general category” work permit (plantation, construction work permit etc..) while you are already in Malaysia. For such type of work permits, the applicant MUST BE OUT OF MALAYSIA. So, be careful form “Flying Agents” who may make many promises to you in this regard.

      The only option is; you register your own company and then apply work permit as “Company Director”/DP10 visa Malaysia which is such work permit which you can apply EVEN if you are already in Malaysia. If any Malaysian company hires then why you have to pay for the process, your employer company should pay the charges. But if you are buying work permit then it means the company will be charging you too much even such work permits become “a useless sticker” when Immigration Police catches. You must be genuine employee of the company, getting at least RM5000 Salary/per month OR you register your own company in Malaysia and then apply your work permit (DP10 Visa) from your own company as “Company Director”. This is the best and easiest way to settle in Malaysia. The people who buy work permits through “Flying Agents” are always in trouble. Even now a days, immigration department continuously raid on such people who are not genuine employee but having work permits.

      DP10 Work Permits are ALWAYS issued to employees or to the Owners of the company. Employees are those who get minimum RM5000 salary per month. So, if you are NOT a GENUINE employee and you are NOT getting any salary from the company, it means you are BUYING work permit from “Flying Agents”. You will be in trouble whenever you are caught by the police. Because EVERY work permit sticker has the address and designation on it. Immigration will check from LHDN (tax department) that how much your company and you, have paid the taxes to the Government.

    I’m a commercial and corporate photographer based in Pakistan. I’ve been doing some research lately to go abroad. There is a visa in UAE known as Freelance License (for a specific category) in which I can go there and work as a freelance and not under the payroll of any company. It is like a freelance business which does not necassary require any office. A virtual office can do as well.

    Can you please guide me if there is a similar category visa in Malaysia as the scope of photographers is wide in Malaysia and I plan to come there with my wife and work my living there. I have done the research for MM2H but the investment in it is too big for someone like me.

And if you try to buy through any “Flying Agent”….when you are caught by the immigration police…you will be deported back to your country…because…every work permit sticker contains “Physical Address” of the company where you work. And if you buy such visa..it means you are not genuine employee of the company. Be very careful for such action.       Ali>> Work Permits are always applied by the company for it’s employees. You cannot apply individually. So, once you are confirmed with any Malaysian company (which has a prescribed “Paid Up capital”) and the Employer company is willing to pay you RM5000/per month minimum Salary, then your Dependents (Wife, Children under 21, and parents) are automatically entitled for “Dependent Pass”.

      But be careful, now a days there are many scams regarding Job Offers. Many Nigerian do such scams. They send emails to international applicants and ask them to pay a sum of amount for visa/work permit processing. In fact, the big companies NEVER ask for payments from prospective job seekers. Even Malaysian Immigration Department NEVER send emails to pay the immigration fee.

      On air port, you MUST answer according to the visa which you hold. If you are coming to Malaysia on Tourist/Social Pass, how a tourist can obtain a visa for Job seeking. It means you obtain the visa from Malaysian embassy by making false statement that you are going to Malaysia for Tourism. So, never say anything which contravene the visa category you hold.

      To Sponsor the family, the Salary MUST be RM5000/per month (minimum).

      If you cannot find such job, then the best options is Register your Company in Malaysia and then apply work permit as Company Director. For this, you may contact QADKAM Sdn Bhd, Malaysia.

      Ask the person/company to show the proof, whether they are licensed Company Secretary or not! You can check this from any company which they have incorporated before. Ask them to show the documents of any company which they have incorporated before this..and then see what is written on “{Documents Lodged By:}“ a space provided on bottom of Form24 or Form49 of EVERY COMPANY in Malaysia. If there, you find their company name (the company who is claiming you that they can register your company with paid up capital) go ahead BUT if you don’t find their company name on this space {Documents Lodged By:} It means the person/company you are dealing is just a “Middleman” company or “Flying Agent”!
      Furthermore; According to Government of Malaysia’s rules, ONLY Malaysian citizen can be the “Company Secretary” so if you are dealing with any “Foreigner” (may be from your own home country) then it means you are dealing with an “AGENT”…not with a “Company Secretary” of a “Company Secretarial Company”. Be careful to be the victim! Contact your embassy in Kuala Lumpur and ask how many people from your country have become the victim of such “Agents” who normally belong to client’s own home country.

      For working and settling in Malaysia we have suggested the best and leading Government of Malaysia licensed company dealing with company registration in Malaysia which also assists the clients for complete business setup in Malaysia. After registering Malaysian company, you may apply your Work Permits (Expatriate Work Permit/DP10). If you come on visit visa again and try to get the “General Category Work Permit” (plantation, construction etc…), you will get nothing…just the sweet promises of “Flying Agents”!. Who ever claims, may cheat you. There is NO SYSTEM of immigration department to lodge the general category work permit application in the computer system when the applicant is within Malaysia.

          Only DP10 category of work permit can be applied while you are here in Malaysia and once DP10 category work permit is approved, you can change your “Social Pass (visit visa) into “Expatriate Employment Pass” (DP10).
          You can apply DP10 only, if you have your own company or you get a job in a company which has prescribed paid up capital and pays you minimum RM5000/per month salary (it is very difficult to find a such genuine job!). So the easiest way is, register your own company and apply DP10 work permit as “Company Director”.

And gibe me something to do, Instead of sitting at home trying not to get fat. Any light to this dark tunnel?

      get the Spouse Visa if your marriage is registered in Malaysia. It may cost you around RM3000 to RM5000 in total including endorsement by Immigration Department to work any where.

    I would like findi out the folllowing about Proffesional visa. I have a friend who is a philipino national in malaysia on visitor visa. She has a degree in Nursing from the philipines and trying to get a Pro. Visa here with an ultimate aim of going to other countries.
    What would be the processing fee for such visa and how long will it take.
    And on the other hand, how much will be the cost of processing a service sector visa.
    What would be the approximate price if u seek the services af an agent and if the potential employer helps getting the visa.

      lin>> According to Immigration Department new rule, Foreigner MUST has minimum RM500,000 paid up share in the company. You can apply employment pass only if your share is minimum RM500,000 in the company even in joint venture with local Malaysian citizen.

      Momin>> Work Permits are always issued to “Employees” or to the “Management” of the company.But if you BUY work permit from any agent, it may drag you in trouble. because, every Work Permit sticker has the “Employer/Company name” , “Address” and “Designation”. Just imagine…if immigration police stop you on any check point and immigration officer asks your visa status. Definitely, you will show him your passport. What if the police/immigration officer ask you to call your employer and ask your employer to come and take you from police station. Do you believe.. your “Employer” will know/recognize) you? OR he will come to police station to take you? I assume nobody will be coming to police station to take you from police custody. Employer will never come because you bought the work permit through “Flying Agent”…you were NOT a genuine employee so the employer will never confirm your employment status even no employer can confirm your status because to confirm, he will be required to show your salary slips, tax deduction etc…So such situation will result in detention in jail followed by the Deportation back to your home country. It means that such Work Permit are valid only until you are not caught by the immigration. And when you are caught, such Work Permits are remain just a useless stickers! May be you can come and go out of Malaysia by using such work permits, but once caught and any immigration officer wants to confirm your employment status, then you will be in trouble!

      Even, in these days there many “Flying Agents” who offer “Professional Work Permits” as “Company Director”. These work permits are more dangerous. Because Flying Agents get such work permits by showing you a Director/Shareholder in a Malaysian company. Most of the cases, you will never know that in which company you are “Director/Shareholder” and what business your company is doing? And just imagine…You buy such work permit and start staying in Malaysia and then…one day, you are coming very happily back to your home country and you go to Kuala Lumpur International Airport to take flight to go back to your home country. When you reach Immigration counter and present your passport to the officer…suddenly officer inform you that “Hello Mr…YOU ARE A DIRECTOR OF A COMPANY WHICH HAS GONE BANKRUPT OR HAS DONE SOME FRAUD…SO YOU CANNOT GO BACK TO YOUR HOME COUNTRY WITHOUT POLICE INVESTIGATIONS OR PAYBACK THE BANK LOAN WHICH YOUR COMPANY HAS TAKEN AND NOW UNABLE TO PAYBACK” Because, according to SSM ACT 1965, you are equally responsible for your company’s dealing if you are Director of a company.

      So, please be careful from “Flying Agents” who offer such permits just for money. They never think that what will be happening to innocent foreigner. One more thing…most of the ‘Flying Agents’ always cheat the people who are from their own home country.

      So the best way to get Malaysian Work Permit is; find a job and then your employer will apply your work permit. OR register your own company in Malaysia and apply work permit as Company Director. If you want to register your company in Malaysia, QADKAM Sdn Bhd may assist you to apply Work Permit as Company Director.

      Fahad>>If you are NOT shareholder in your current company and going to have a job in other company where you also have no share, then you have to undergo a cooling off period of 3 months. But if you are shareholder in both companies, then you don’t need to undergo for cooling off period.

      Followings are the requirements for 10 years Pass under new policy;
      1. Academic Qualification: Bachelors / Masters / PHD degree in any discipline from a recognized Institute of Higher Learning, Diploma or a Professional / Competency Certificate from a recognized Professional Institute.
      2. Total years of working experience: MINIMUM total of 5 years working experience.
      3. Years of experience working in Malaysia: MINIMUM total of 3 years working experience in Malaysia and it must be continuous.
      4. Salary: MINIMUM gross annual salary of RM144,000.00.
      5. Industry/Sector: Applicant from all industries and sectors are welcomed to apply.
      6. Local Sponsor: Applicant must have a local sponsor i.e Malaysia Citizen, 21 years old and above.
      7. Income Tax File No: Applicant must have an Income Tax File Number in Malaysia and have paid income tax for a MINIMUM of 2 years.
      8. Recommendation: Any recommendation from regulatory bodies will be an added advantage.

      Please check Form 24 (page 3) and see Section “D”. If there is clearly written that “the total issued capital of the company now stands at 500,000 shares of RM1.00 each and the Paid Up capital is RM 500,000.” and…
      If the Form 24 (page 3) section “D” bears the exact words of Paid UP capital RM 500,000 than you can apply work permit on your company.

      BUT if it bears only in Section “B” that “Authorized Capital” is RM 500,000 but on section “D” it is written ONLY RM 2 or RM 5 or RM 10 or RM 50 or any other amount less than exactly RM 500000 then it clearly means that you CAN NOT apply work permit on that company.

      If you are not being cheated by any “Flying Agent” and the company is really Incorporated with above mention words of RM500000, then you may apply work permit on this company because Immigration Department requires company with PAID UP CAPITAL of RM 500,000 not ONLY with AUTHORIZED CAPITAL.

      Paid Up capital means “CASH” and Authorized Capital means NOTHING..just an assessment!

      Please visit MalaysianOffice to read carefully to understand where this detail appears. Simply..Section “D” of Form 24 (page 3) of Compnaies Commisison of Malaysia clearly states that how much the capital is FULLY PAID UP. If in this section your PAID UP CAPITAL is minimum RM500,000 written the you may apply work permit. be careful…if the RM 500,000 is mentioned ONLY in Section “B” of Form 24
      (Page 3) then it means it is ONLY AUTHORIZED CAPITAL. BUT for work permit it MUST be mentioned also in Section “D“.
